What exactly is a fiduciary?

A fiduciary is someone who is legally and ethically obligated to act in another person's best interest. In the context of family care and estate management, this role carries significant legal authority and responsibility.

Not everyone who calls themselves a fiduciary is licensed or properly regulated. Knowing the difference — and knowing how to verify credentials — is what protects your family.

  • Conservator Court-appointed to manage an individual's personal affairs, health care and/or finances when they can no longer do so themselves.
  • Trustee Manages assets held in a trust on behalf of beneficiaries, bound by the trust's terms and probate code.
  • Guardian Appointed to make personal and medical decisions for someone who lacks legal capacity to do so.
  • Agent (POA) Authorized to act on someone's behalf under a Power of Attorney for financial and/or healthcare — typically before incapacity becomes a legal matter before the courts.
  • Representative Payee Manages government benefits (Social Security, VA) for individuals who cannot manage funds independently.
